It should effect you during the fight if anything. Unfortunately we don't have much room to be creative, but I absolutely hate permanent stat reduction from something that is hardly a mistake caused by lack of mechanics.
With the bullshit laws removed it should be pretty obvious what not to do and what unit you shouldn't use. I don't think hitting select at the start of a fight is too much to ask.
